Request Delta County Case Records

Finding a Delta County court case record starts with one question: which court handled the case? The Clerk of Court and the court itself keep the files, so that office is where a request begins. A Delta County court case records search can start online, since case history there often helps you locate a file. Online results are not always complete, though. Some matters are sealed, confidential, or otherwise restricted from public view. Before asking for copies, confirm that the right court holds the record you need.

Delta County Court Record Requests

Michigan court rules call the public case history the register of actions. It counts as part of the court case record itself. So the clerk of the right court is where a copy request begins. That court's records system works too. Delta County runs three state trial courts: the 47th Circuit Court, the 94th District Court, and Delta County Probate Court. Family administrative material sometimes sits with Delta County Friend of the Court instead. The county clerk can help you find your way around the courthouse. Just do not assume that office holds every court record.

  1. Identify the court, case number if known, party or business name if appropriate, document or event sought, date range, and whether an ordinary or certified copy is needed.
  2. Use MiCOURT Case Search to locate public case-history information where it is available.
  3. Ask the court of record about inspection, a counter request, a phone inquiry, or a written or mailed copy request. Public inspection and retrieval are not subject to a general access fee, while reproduction may cost.
  4. Use the county FOIA channel only for county public-body records or when the actual custodian directs that route. It does not override court-record restrictions.
  5. Use the separate Friend of Court request form for FOC-held material, and ask Probate about its own record and filing procedures.

Need to find the case first? A Delta County docket search can give you the court designation and the public case-history lead your request needs.

Delta County Court Record Custodians

Who holds a Delta County record depends on the court and the record type. Traffic and civil infractions, misdemeanors, felony preliminary matters, and bail all belong to the 94th District Court. That court also handles civil cases up to $25,000. The 47th Circuit Court is the general-jurisdiction court and includes family-division work. Delta County Probate stands as its own court. A Circuit case history and Friend of Court administrative records can demand separate access channels. That can happen even for the same family matter.

The official Delta County directory names the courts and county offices at the courthouse. Call ahead if a particular counter, entrance, or access condition matters to your visit. The general directory number is (906) 789-5100. No single desk is guaranteed to answer every court-record question, though.

Note: State the court, case number, record type, date range, and copy type clearly. Staff can then send you to the right custodian.

Kinds of Court Records

A public Delta County case-history entry is not the whole file. What you can get depends on the court. The case type and the access rule matter too. Civil matters may sit in 94th District Court or Circuit Court. A criminal docket can shift from the 94th District Court to Circuit Court. That happens once a felony is bound over. Probate, family, and Friend of Court material each carry their own boundaries too. Ask the court for a public copy. Do not trust a general web result to include every filing.

  • Register of actions or case history, including public entries and events.
  • Public orders, judgments, and dispositions where the court permits access.
  • Civil and criminal case-file material held by the court of record.
  • Traffic and civil-infraction case information from the 94th District Court.
  • Probate court records subject to the rules for that case type.
  • Friend of Court administrative records through the separate FOC process.

Delta County FOIA Request Details

The Delta County FOIA page lays out a written-request channel for county public records. No particular form is required. A requester may use the county form or any other sufficient writing. That could be a letter, fax, or email. Describe the record, the date range, the format, and how you want it delivered. When the county has the capability, it can provide non-paper media or email instead.

Under MCL 15.235, the FOIA coordinator must respond to a written request within five business days. The office may take one extension of up to ten business days. That clock measures the response, not instant production of the records. The county's denial form covers inspection, copies, certified copies, delivery, redaction, and appeal information.

For a court file, go to the court first and Michigan Court Rule 8.119. FOIA cannot pry open a sealed, nonpublic, juvenile, or otherwise restricted court record.

Court Records: What They Contain

The register of actions is the case history the clerk keeps. A public Delta County result may show the case number, filing date, court, category, parties, attorneys where public, assigned judge or jurist, status, register entries, and published event or disposition information. It does not promise a downloadable docket PDF, document images, transcripts, a full financial ledger, related-case links, or a stable public Delta detail link. Do not read those items into a case listing.

Case NumberThe identifier used to locate the case history and request the correct file.
Filing DateThe public opening date when the register or search result provides it.
Case CategoryA visible court or case-type label that helps identify the proper record system.
Register EntriesDated history entries for public filings, notices, hearings, orders, or other events.
DispositionA public judgment or closing event where the court makes it available.

A register entry like "motion filed" or "order entered" can show up even when the document itself is unavailable, restricted, or obtainable only by asking the court directly.

Note: Ask the court whether the item you want is a public document, a register entry, or material available only through another process.

Delta County Friend of Court Records

Delta County Friend of Court handles support, parenting time, custody, paternity, and related administrative services. Its records route is not the Circuit Court case-history route. For FOC-held administrative material, use the Request to Access Friend of Court Records on the official forms page. Then follow whatever access decision comes back. A general case search will not reveal support-enforcement or work-product material. The official form collection marks this record type as its own separate access channel.

A publicly visible Circuit case history does not override family-case privacy rules or court-rule limits on access.

Copy Fees and Certification

An ordinary Delta County copy and a certified copy are two different requests. Certification is the clerk's official verification of the copy. Inspection is a separate form of access entirely. The local Court Section Fees page lists the certified-copy charge and several filing fees. It does not give a full schedule for plain copies. Plain copies, docket sheets, searches, transcripts, and exemplified copies are not all priced there. Ask the relevant court for the current cost before you order.

Officially Listed ItemAmount

Certified copy, each additional page$1
Filing fee$175

Divorce with minor children filing fee$255

The Clerk's page is a practical first stop for county contacts. Before paying for copies, confirm with the court of record whether it or the clerk holds the specific case file or certified record you need.

Delta County Probate and Federal Records

Delta County Probate Court runs on MiFILE, but that platform is built for attorney filing. Self-represented litigants do not have to e-file under county guidance. A MiFILE filing does not become publicly viewable there. Access follows the court record and case type. For a state Probate record, start with the Probate Court or its MiFILE information instead of assuming every filing lands in public search results.

Federal cases live in a wholly separate system. CourtListener/RECAP offers free federal opinions plus some contributed docket material. Its coverage is spotty, though. It is not the official Delta County state-court record.

For official federal access, turn to the Western District of Michigan and its PACER or CM/ECF routes. Delta County sits in the Northern Division.

The official PACER pricing page spells out the costs. Federal access can carry per-page charges, document caps, and separate rules for search-result pages, transcripts, and audio.

PACER is the federal government's official case-access channel. It holds no Delta County state-court dockets, and the Western District's Marquette courthouse page identifies the local federal courthouse for Northern Division context.

Bankruptcy follows the federal system too, not MiCOURT or MiFILE. The official Western District bankruptcy information maps the Marquette route for Upper Peninsula cases.

None of those federal channels will surface a Delta County state file. Traffic, family, civil, criminal, and Probate cases all stay in the state system.

Access Rules for Court Records

Access rules cover anything not restricted. Michigan's court rules draw lines between confidential, nonpublic, and sealed material. A case history can be public while a document inside the file stays closed. Juvenile files follow separate legitimate-interest rules. MiCOURT's public exclusions also include adoption, juvenile and child-protective proceedings, mental illness, name changes, personal protection orders, wills, and other sensitive categories.

Michigan record-access rules:

MCR 8.119 describes court case records, the register of actions, inspection, and reproduction rules.

MCR 1.109 addresses redaction of protected information in court filings and copies.

MCR 3.925 sets a legitimate-interest standard for juvenile-file access.

Delta County Redaction Boundaries

MCR 1.109 sets redaction duties. Parties and attorneys must redact protected information, including Social Security numbers. The clerk can redact protected personally identifying information upon written request. This applies to a paper or electronic copy. A 2024 Michigan court memo says MiCOURT displays year of birth, masks registers of actions, and blocks public user searches by driver-license number. Leave protected personal information out of your request unless the court requires it for a lawful purpose.

"No public record exists" can mean several things. The record may be restricted, sealed, or exempt. It may be held in a different system or absent in the requested public form. That phrase is not a conclusion about any underlying event. Court staff can point to procedures and custody. They cannot give legal advice on access, a sealed record, or a case outcome.

Ask for the public version of a clearly identified court record. Let the clerk apply the required privacy and access rules.
